App. -Waco July 6, 2011, pct. denied) (mem. op.) - Evidence showing drug or alcohol use must not be so far removed in time as to make it irrelevant. Driver's failed drug tests four years and eight months before the case were irrelevant and inadmissible.

In re J.O.A., 283 S.W.3d 336, 345 (Tex. 2009) - Sufficient evidence to support finding of endangerment even though father had made significant recent improvements because "evidence of improved conduct, especially of short-duration, does not conclusively negate the probative value of a long history of drug use and irresponsible choices."
Causal link
In the Interest of L.C.L, 599 S.W.3d 79 (Tex. App. – Houston [14th Dist.] 2020, pet. filed) - Requirement for a causal link between the substance use and actual harm to the children before the judge imposed any restrictions on the abuser.
Recommendations
Crafting a Comprehensive Drug Testing Regimen for Unsupervised Access and Possession
Utilize hair or nail drug tests to establish a baseline of drug use.
Utilize Sweat Patch to deter and detect intermittent and/or daily drug use. May be utilized in 7-day increments.
Utilize Sweat Patch for 60-90 days (depending on usage) in conjunction with a Step-Up Possession Plan.
Utilize random urine tests, if necessary, once possession schedule thresholds are met.

Letter of Interpretation
Request Letters of Interpretation in cases where the client disputes a positive drug test. A Letter of Interpretation can determine if the positive test is a result from ingestion or environmental exposure.

Alcohol Testing
Utilize Urine Testing if you suspect heavy drinking 80 hours prior to collection.
Utilize PEth Blood Spot to detect drinking up to 2-4 weeks prior to collection. PEth's average half-life is 4.5 days. This means that every 4.5 days the level of Peth is cut in half. For example: If an average person with a PEth level of 1000 ng/mL stops drinking, it would take approximately 2.5 weeks for them to fall below the 20 ng/mL cut-off level.

Hair Testing for Children (ChildGuard)
This can establish the causal link between the substance used by the adult and the actual harm to the child. ChildGuard testing detect passive exposure to drugs in the child's hair up to 3 months after exposure.
